Mental Health Tribunals

We regularly act for clients who have been detained under the Mental Health Act providing advice and representation in mental health tribunals.

Court of Protection

The Court of Protection was created under the Mental Capacity Act 2005 and looks after property, financial affairs and personal welfare of people who lack the mental capacity to make their own decisions.

Best Interests

Decisions made on behalf of someone who lacks mental capacity must be made with their best interests in mind.  Where these decisions may have been made without this consideration, we often act on the individual’s behalf to ensure things are put right.

Deprivation of Liberty Safeguards (DOLS)

Brought in to provide additional safeguards for people who lack mental capacity, they help ensure that any restriction of the person’s freedom is only done in their best interest.

Judicial Reviews

These are a powerful tool to help individuals challenge the method a public body uses to reach a decision.

We provide advice and representation for clients who are attending a Hospital Managers Hearing wherever you may be across the north west.

Seclusion & Restraint Issues

Where there are issues regarding the use of restraints or seclusion, our team can provide you with expert advice.

Meet our mental health team

Human Rights

Human rights form the basis of all other law and include things like the right to life and to be free from inhuman and degrading treatment.  We act in cases where there may have been breaches of these rights and help to rectify matters.

Hospital Transfers

We deal with a number of cases falling under section 47/49 of the Mental Health Act in relation to hospital transfers.

Nearest Relative Displacements & Rights

Hogans can help provide expert advice on what rights a person’s ‘nearest relative’ have and assistance with respect to defending “displacement proceedings”..

Community Care

We provide a wide range of services under the ‘Community Care’ area of mental health law.  This usually applies to people with a mental health condition who are not in hospital or detained under the Mental Health Act.
